Intellectual Property

An intangible asset needs statutory protection as much as a plant needs a fence.

A trademark, trade name, design or patent is an asset that is recorded, sold and pledged — yet its protection is often neglected until an infringement occurs.

We provide pre-filing clearance searches, registration with the Saudi Authority for Intellectual Property, international registration through the Madrid System, renewals and deadline monitoring, assignments and licensing, oppositions against similar marks, defence before dispute committees, and damages claims in counterfeiting cases.

We also draft trademark licensing and franchise agreements and review intellectual property clauses in development and supply contracts — where many clients lose ownership of what they paid for because of a single clause.

Frequently asked questions

How long does trademark registration take?

From filing to registration typically takes several months covering examination, publication and the opposition window, and longer if a third-party opposition or examination objection is raised.

Does Saudi registration protect the mark abroad?

No. Protection is territorial. To cover other markets we file through the Madrid System or directly in each target jurisdiction according to the expansion plan.

What should we do on discovering counterfeiting of our mark?

We first document the infringement through a report and evidentiary purchases, then serve a formal notice, and if it continues we file a complaint with the competent authority and a damages claim supported by a quantified loss assessment.
